Freiberufler or Gewerbe? How to classify your self-employment in Germany
You are a freelancer (Freiberufler) if your activity is listed in § 18 EStG or is similar to a profession listed there – above all for scientific, artistic, literary, teaching or educational work. Everything else is usually a trade business (Gewerbe). The classification determines trade registration, trade tax (Gewerbesteuer), the IHK fee and the obligation to keep double-entry books.
Registering a business in Germany: your trade registration (Gewerbeanmeldung) step by step
You register a trade business (Gewerbe) no later than the first day of your activity at the trade office (Gewerbeamt) of the municipality where your business is based – online in many cities, otherwise in person. It usually costs €15 to €65, often takes only minutes and sets off a chain of events: the tax office (Finanzamt), the Chamber of Commerce (IHK) or Chamber of Crafts and the employers’ liability insurance association (Berufsgenossenschaft) will contact you afterwards.
